Action Item. Certification of Meeting’s Public Notice – Noticed by Molzof. 4. Action Item. Approval of Agenda – Prepared by Molzof. o Motion to approve the agenda as posted. Scallon/Orr. – Passed Unanimously. 5. Action Item. Approval of draft September 6, 2024 Meeting Minutes – Prepared by Molzof. o Motion to approve the September 6, 2024 meeting minutes as presented. Morris/Lieurence. Passed Unanimously. 6. Updates. Public Comment – Time for public comment may be limited by the Chair. 7. Updates. Announcements by Commissioners REPORTS & COMMISSION BUSINESS 8. WRRTC Financial Report – Huttenburg, Treasurer o Motion to approve the August, 2024 Treasurer’s Report. Kannard/Gilberts. Passed Unanimously. o Motion to approve the Boardman & Clark Invoice that was postponed at last month’s meeting for the revised amount of $7,084.00. Anderson/Kannard. Passed Unanimously. o Motion to approve the 3rd Quarter, 2024 payment to Southwestern WI Regional Planning Commission in the amount of $8,166.25. Morris/McCumber. Passed Unanimously. 9. Wisconsin & Southern Railroad’s Report on Operations – Lucht, WSOR Lucht reported on maintenance activities in the Village of Darien and the partnership to close 3rd Street crossing for safety and efficiency purposes, as well as assistance with reconstruction of WI Street; WSOR has petitioned OCR for closure of Powers Avenue in Madison; progress is being made on private crossing agreements and the right of entry, both of which are required; WSOR met with the City of Lodi regarding a possible pedestrian underpass; work on property issues with Scott Edmundson, Misty, and Marty has started; business is slow right now; Fox Lake tie and resurface project is complete; and work is underway with Village Edge Road in Arena. WRRTC OCTOBER 4, 2024 MEETING MINUTES – APPROVED 11/8/2024 2 10. WisDOT Report – Mohlke - WisDOT. Mohlke stated that the Janesville Bridge project is progressing with preliminary engineering and environmental studies beginning; Merrimac Bridge project is going well and updates were provided in packet; and the Freight Rail Conference is scheduled for November 12th, please let Molzof know if you want more information and she will get in touch with Mohlke. 11. Committee Updates / Recommendations Huttenburg stated that Treno Services started work on Monday, September 30th and the project is going well. 12. Agreement with Partners, WSOR and WisDOT, as it pertains to Commission owned property and professional services sought – Krueger, Chair. 8a. Consideration of and action on possible motion to adjourn to closed session pursuant to Wis. Stat. Sec. 19.85(1)(e), which permits the Commission to convene into closed session for the purpose of conducting specific business, whenever competitive or bargaining reasons require a closed session, for the purpose of bargaining agreement with partners as it pertains to commission owned property and possibility of seeking competitive professional services as stated under Action Item #8. – Krueger, Chair. o Motion to adjourn to closed session pursuant to Wis. Stat. Sec. 19.85(1)(e) as noted above allowing WisDOT and WSOR attorneys and representatives to stay. Scallon/Reimann. Upon Roll Call Vote, Motion Passed Unanimously. Meeting adjourned to closed session at approximately 10:27 am. Meeting reconvened into open session at approximately 10:56 am. 8d. Possible action on closed session matter, Agenda Item #8. – Krueger, Chair. o Motion to approve WSOR attorneys to proceed with filing a notice of formal claim jointly on behalf of Wisconsin Southern & Railroad (WSOR) and the Wisconsin River Rail Transit Commission (WRRTC) against the City of Baraboo, and to authorize the WRRTC Litigation Committee to act on behalf of the Commission in negotiations while said claim is pending.
