HomeMy WebLinkAboutCty Bd Feb 21 20171 Grant County Board of Supervisors February 21, 2017 The Grant County Board of Supervisors met on Tuesday, February 21, 2017 at 10:00 a.m. in Room 264 on second floor of the Administration Building, Lancaster, WI pursuant to the adjournment of the December 20, 2016 meeting. Robert Keeney, County Board Chair called the meeting to order and the Pledge of Allegiance was recited. Verification of compliance with the open meeting law was a notice in the Herald Independent stating the date, time and place of the County Board Meeting and posted in two public posting locations and the county website verified by Linda K. Gebhard, County Clerk. Agenda: Don Splinter, seconded by Roger Guthrie, made a motion to approve the amended agenda as printed. Motion carried. Minutes: John Beinborn, seconded by Dwight Nelson made a motion to approve the minutes of December 20, 2016 with the following changes. Kurt Berner’s name was spelled as Curt, change the shooter practice even to event on page 2, on page 9 change the word save to safe and in the committee reports Ag and Extension change John to James Schneider. Motion carried. Memoriam: Chair Robert Keeney presented the memoriam to Louella Vosberg. 2 RESOLUTION #27-16 IN MEMORIAM OF LOUELLA VOSBERG The Grant County Board of Supervisors, assembled this 21st day of February, 2017 issues the following commemoration: WHEREAS, the death of Louella Vosberg from the Town of Clifton has come to the attention of this body; and WHEREAS, Louella Vosberg served on the Grant County Board of Supervisors from April 1998 to April 2008 representing District 13, Towns of Clifton, Lima and Village of Livingston; and WHEREAS, her many friends and acquaintances will long cherish in memory her willingness to serve through public office and to assist in the interest and welfare of Grant County. NOW, THEREFORE BE IT RESOLVED, that the Grant County Board of Supervisors commends the life and public service of Louella Vosberg and that this memorial be set forth at length upon the minutes of the meeting and that a copy, properly attested by the signature of the Chairperson and the Clerk, be sent to the family. /s/ Robert C. Gebhard, County Clerk A motion was made by Mark Stead, seconded by Grant Loy to approve the Memoriam for Louella Vosberg and have the County Clerk send the certificate to her family from the Grant County Board of Supervisors. Motion carried. Communications: Chair Robert Keeney informed the Board Vern Lewison had passed away; a memoriam will be presented at the next County Board Meeting in March. The CGI video tour is up and running on the internet, modifications were made. Chair Keeney thanked James Schneider, Communication Agent from Extension Office for the work he did on the presentation. Now that the tourist season is beginning, Chair Keeney reminded all the Board members the Kieler Information Center is open to start placing Grant County information there. Employee Recognition: Chair Keeney presented Cathy McPhail with an Employee Recognition Certificate for her 27 years of service with the Ag and Extension Offices. Cathy thanked the Board for the opportunity to work with the 4-H Groups of Grant County. Chair Keeney presented an Employee Recognition Certificate for Mary Koenen to recognize her 31 years of service with the Grant County Health Department. The certificate will be sent to her. Chair Keeney presented an Employee Recognition Certificate for Pat Perkins to recognize her 38 years of service with the Grant County District Attorney Office. The certificate will be sent to her. Chair Keeney presented an Employee Recognition Certificate for Colleen Nelson to recognize her 33 years of service in the Clerk of Circuit Court Office. The certificate will be sent to her. Appointments: Chair Robert Keeney presented the following appointments for approval by the Board of Supervisors. 3 Chair Keeney asked for approval to renew the appointment of Dave Lambert as the Highway Commissioner. This appointment is for a two year term; the new term began on January 1, 2017 and expires on December 31, 2018. Mark Stead, seconded by Lester Jantzen, made a motion to appoint Dave Lambert as the Highway Commissioner for a term of two years. The term will begin on January 1, 2017 expiring on December 31, 2018. Motion carried. Chair Keeney asked for approval for the Emergency Fire Warden for 2017. In accordance with section 26.12(3) and section 26.14(3) of the Wisconsin Statutes, we recommend the following business to act as authorized Emergency Fire Wardens for the prevention and suppression of forest fires in Grant County for the year 2017 calendar year. Once this business has been approved by the Grant County Board of Supervisors, a signed copy by the Grant County Board Chair should be sent back to the State of Wisconsin, Department of Natural Resources. Keeney, Grant County Board Chair 02/21/2017 A motion was made by John Patcle, seconded by Patricia Reynolds to approve Krogen’s Do It Best Store for the appointment of the 2017 Emergency Fire Warden for Grant County. Motion carried. Chair Keeney asked for approval to appoint Betty Kerkenbush, who would represent the public, to serve on the Dickeyville Brickl Public Library Board. A motion was made by John Beinborn, seconded by Lester Jantzen to approve the appointment of Betty Kerkenbush to serve on the Dickeyville Brickl Public Library Board. Motion carried. Grants: Steve Braun, Emergency Management asked permission to accept $44,960.00 from FEMA for the Hazard Mitigation Plan for Grant County. This grant must be updated every five years mandated by FEMA to stay in compliance. The grant money will be used for the updating process. A contractor will be hired to help in this process. This grant helps to reduce the County’s vulnerability during an emergency event. There is an in kind match of $15,000.00 which will be satisfied by hours worked by the Emergency Management employees. Steve stated with this plan in place it also opens more avenues for future grant money that may help the County and will be used as an advisory plan in the case of emergencies. A motion was made by Roger Guthrie, seconded by Ron Coppernoll, to accept the grant money of $44,960.00 from FEMA for the Revision of the Hazard Mitigation Plan for Grant County. Motion carried. 4 Orchard Manor, Carol Schwartz, Director asked for approval for a grant from The West Bend Safe Resident Assistance Endowment. The Orchard Manor Committee has approved applying for the endowment for Orchard Manor. This endowment is partnered by EZ Way Inc., Charitable Grant Foundation available to only non-profit organizations. The purpose of this Endowment is to approve and subsidize 90% of the cost of safe resident assistance equipment. Orchard Manor will be applying for $5,000.00 for a Hoyer lift and $2,000.00 for a sit to stand lift. There will be no match for the County. John Beinborn, seconded by Gary Ranum, made a motion to approve the request for the Endowment for $2,000.00 for a sit to stand lift and $5,000.00 for a Hoyer Lift for Orchard Manor. Motion carried. Jack Johnson, Chief Deputy Sheriff asked for permission to apply for $9,900.00 for a Tactical Hearing grant for tactical communications and hearing protection from the Dubuque Racing Association, funding term from February 1, 2017 to December 1, 2017. No match to the county. Don Splinter, seconded by John Beinborn, made a motion to approve the request to apply for the Tactical Hearing Grant money of $9,900.00 from the Dubuque Racing Association for the Grant County Law Enforcement contingent on the approval of the Law Enforcement Committee. Motion carried. Resolution Regarding Quit Claim Deed to former Owner-Tax Deed Property: Louise Ketterer, Grant County Treasurer presented Resolution to the Board. RESOLUTION NO. 28-16 The Grant County Board of Supervisors herein authorizes the Grant County Treasurer to Quit Claim to the former owner, Robert A. Dilley, the following described piece or parcel of land, lying and being situated in the County of Grant, to-wit: Lot Three (3) of Block Six (6) of Park Addition to the Village of Blue River, Grant County, Wisconsin, according to the recorded map or plat thereof. TAX KEY PARCEL NUMBER: 108-00199-0000 Property Address: 503 David Street, Village of Blue River, Wisconsin 53518 Said property had been acquired by Grant County by means of a Tax Deed (Exhibit 1) as referenced in Ordinance # 39 (Exhibit 2). As outlined under Grant County Ordinance Section 242-3, Repurchase option, subsections A and B have been satisfied with Robert A. Dilley having paid to the Grant County Treasurer all delinquent taxes, accumulated interest charges and all costs incurred by Grant County in proceedings necessary to obtain and file the tax deed in the amount of $5,882.49. Therefore, the Grant County Board of Supervisors exercises the repurchase option as listed in Section 242-3 of the Grant County Code. Motion carried. 5 Ordinance 65 ATV/UTV Amendment: -Dave Lambert, Highway Commissioner presented the ATV/UTV amendment to the Board of Supervisor. The amendments were approved by the Highway Committee and Traffic Safety Committee. ORDINANCE NO. 65 (Proposed Hwy Committee 01/12/17 and Traffic Safety Committee 02/15/17) AN ORDINANCE TO REPEAL AND RECREATE SECTION 268-4(a)-(oo) OF THE CODE OF ORDINANCES OF GRANT COUNTY, WISCONSIN, RELATING TO ALL-TERRAIN AND UTILITY VEHICLE ROUTES. Motion carried. Request for $15,837.00 from General Fund for Institute Supplement Payment to Unified: Nancy Scott, Finance Director presented the request. Pursuant to the County’s Resolution 44.84 allowing a supplemental payment for treatment in State Mental Health Institutes if treatment costs for an individual exceeds $40,000 for a year. Grant County’s is obligated to pay the amount of $15,837.00 for 2016 from the General Fund to Unified Community Services. The Executive Committee has approved this transfer of funds. A motion was made by Ron Coppernoll, seconded by Pat Reynolds, to approve the transfer of $15,837.00 from the General Fund to Unified Community Services for patient treatment cost in 2016. Policy Update for Position requests/vacancies: Joyce Roling Personnel Director presented the policy update. 5.12 Position Request/Replacement: When a position becomes vacant, Department Heads must contact the Personnel Director for guidance. Approval from the committee chair is required to start the recruiting process. Confirmation is required from the full committee before filling the position. The vacant position should be reviewed for effectiveness and whether it is still necessary. The job description must be updated before posting. Please see Workplace Job Restructure Policy (5.13) should you be considering a change to the position. (2/14/2017) This was recommended for passage by the Executive Committee. Presentation for $43,000 plus travel expenses from General Fund for a Compensation Study: Patrick Glynn from Carlson-Dettman gave a presentation on the wage and benefit study for Grant County. Gary Ranum, seconded by Grant Loy, made a motion to approve the transfer of $43,000 from the General Fund for a compensation study for Grant County as described in the presentation given by Patrick Glynn from Carlson Dettman on February 21, 2017 to the Grant County Board of Supervisors. WHEREAS, a proof of publication and giving notice to each affected township clerk of such hearing is attached to this document. Chapter 59.69 (5) (e) 4 WHEREAS, the Conservation, Sanitation and Zoning Committee now recommends to the Board of Supervisors of Grant County the adoption of the following map amendments. NOW THEREFORE BE IT RESOLVED that the Grant County Board of Supervisors does ordain as follows. That the Zoning District Map for Grant County will be amended to reflect the following: PETITION #16-40: Rezone request for John & Shelia Schluenz, PIN: 014-00132-0000, to change the zoning classification from FP to A2, to allow for the use of a non-farm residence. Dog Claim(s): Roger Guthrie presented the dog claim from the Dubuque Regional Humane Society regarding a stray dog brought to them on December 9, 2016 by a Grant County Deputy for a cost of $110.00. A motion was made by Roger Guthrie, seconded by John Patcle, to approve payment of the dog claim of $110.00 to the Dubuque Regional Humane Society. Motion carried. 12:00 p.m. Chair Keeney called for a short break so Kurt Berner, The Samuels Group, Eric Lawson and Brian Anderson, Potter and Lawson could set up to present the update on the Law Enforcement/Social Service/ADRC Building project for the County. 12:15 p.m. Chair Keeney called the meeting back into session. Presentation on Design Development on the future facility of Law Enforcement/Social Service/ADRC Building: Eric Lawson, Potter Lawson gave an overview of what has occurred in the design development phase to this point. There have been many meetings since October 2016 when the Board approved the project to go forward. The design development phase gives a more refined layer of detail to the plan 12 than the schematic design phase. More detailed discussions have taken place from the type of the finishing’s in the building, finalized floor plans, layouts of the rooms, interior and exterior finishes, mechanical systems, sizes of electrical equipment, building structural design. Potter Lawson has held many meetings with groups other than the departments involved in this project. Electrical Engineers and Mechanical Engineers have been involved along with the Department of Transportation and Department of Corrections. Eric went over refinements in size and cost reductions that have happened during this phase. Bunk numbers have been reduced but classification levels have not been compromised, special observation pods are still in place and medical areas have remained the same. Eric Lawson stressed the safety aspects; there have been no compromises in this. In fact, he stated that many new facilities being built today are consolidating departments for added safety reasons. Eric also stressed the facility that is being planned has room for expansion built into the plan. Many have asked, “What happens in 30 years when more space is needed?" Eric stated it is just good planning to have this expansion ability built into any plan that is expected to be adequate for many years. Eric said in his opinion, another reason the location works for the County is that there is ample space to add more parking area or structure if needed. Eric continued to explain the interior plans for the building; with the shared spaces and very pleasing appearance it is a very welcoming facility but very effective and will prove to be very versatile for all departments involved. If the Board approves to go forward the target dates will be June 9, 2017 start construction document phase, June or early July 2017 start the bidding process, and begin construction in August 2017. To achieve these totals, The Samuels Group took the documents that were there in each division, sent them out to contractors to bid out in today’s market. O ver the last couple months in construction cost in today’s markets they were finding spikes in the HVAC mechanical and structural steel materials have gone up. The Samuels Grou p built in a small escalator in those two groups. Kurt Berner proceeded to explain the bidding process; how they would handle the bidding of each category breaking them down as much as possible in order to involve local vendors. 14 Kurt explained there would be ways to expedite occupancy for the Social Services/ADRC part of the project. There are ways to schedule that and work with the State and local authorities on occupancy approval and safety codes. The duration and construction schedule can be wor ked through with the construction crews so they know where they need to start to allow for early occupancy by Social Services/ADRC even if the Law Enforcement/Jail is not completed. Dave Bainbridge was given time to present his plan. Chair Keeney wanted to make it clear that the plan being presented by Bainbridge is only an alternative plan. If the project would be separated the project would have to follow the same procedure as has been followed with the projected project on one campus; going out for bids for all private contractors. Dave Bainbridge was asked by the Mark Stead if this facility could be built on County owned property. Dave stated the location on Alona Lane offers everything the County would need in this structure; many of the government buildings are in that location at this time. It is close to the Social Security Office, restaurants, and has safer traffic flow. Dave likes the location; he would not want to change that. He does not own this property at this time; it would have to be purchased from the Lancaster Hospital. Possible Action to move the Facility Project into Construction Document Phase: Chair Keeney opened the floor for discussion. Nate Dreckman, Sheriff asked were the costs would come from for furnishings since it was taken out for the presented estimate. Chair Keeney stated the furnishings were not an 15 actual part of construction cost; they were trying to keep the scenarios the same for all the estimates to keep them all cost effective. John Beinborn questioned the water main. In 1993 the County put in a 12” water main, the county signed on with the city in a 20 year lease in order to recoup any costs for additional hook-ups that might take place. That contract expired in 2015 so the County turned over all ownership to the city. Chair Keeney stated his hopes were that the County could work with the City on the sewer needs in the future to share the cost of a lift station. Ron Coppernoll wondered if the borrowing of money would change if the Board voted to go with the Bainbridge facility on a separate location. Chair Keeney stated the County would have to have similar borrowing terms with that project also, the same needs would exist. Chair Keeney reiterated some of the issues with the 52 Building such as electricity. That property is County owned, at this time we are paying for primary metering which worked in past years with the Fair Grounds and Farm. But in today’s world being charged for secondary metering would be much more cost effective in going forward. Chair Keeney wanted to clarify the question as to why did the County go with a Construction Management Firm. Questions have been raised, should the County stay with a Construction Management Firm or go with a General Contractor. And with either style of operation would the County allow for self- performance. Kurt Berner addressed the question. His company has done it both ways, in his opinion a Construction Manager does not self perform. They are hired to oversee all the quality, scheduling and specs of the project, they are hired to oversee the project; they are the advisors. Kurt feels since this project has started his role was to give the Board the information and look out for their best interests. The moment they would get involved in the bidding project that is when the idea starts that they are in it to line their pockets and that is not the way they do business. His preference is to strictly move on in an advisory role. Carol Schwartz, Orchard Manor Director stated she thinks the Law Enforcement facility works well at the Orchard Manor site. There could be some shared functions that both facilities could do to be more effective because both are 24 hour service facilities, such as food services, maintenance, and snow removal. She did not know if that site is the best fit for ADRC and Social Services. Carol Beals asked Fred Naatz, Social Service Director on the security issues. She was under the understanding Social Services viewed being in the same location as Law Enforcement for added security was a big issue. Lori Reid, ADRC Director also stated having the added security was a plus. Gary Ranum made a motion to go forward into Construction Document phase with Potter Lawson on one campus, Seconded by Dale Hood. Grant Loy asked how a vote can be taken when three Board Members are absent. Ben Wood, Corporation Counsel stated that is a decision the Board will have to make. There is no Bonding issue here; basically all the vote does is to move the process forward. Legally there is not a problem; this 16 vote only takes a majority vote as long as the motion to move the process forward has not changed from prior motions. Chair Keeney reiterated the motion. Gary Ranum, seconded by Dale Hood made a motion to move forward into the Construction Document phase as previously described in the design documents on one campus, one location on the Orchard Manor site.
