HomeMy WebLinkAboutApproved 10-3-2017 CSZC MinutesGRANT COUNTY CONSERVATION, SANITATION, & ZONING COMMITTEE MEETING October 3, 2017 9:00 a.m. Grant County Board Room (#264) Lancaster, Wisconsin The Grant County Conservation, Sanitation & Zoning Committee meeting was called to order on October 3, 2017 at 9:00 a.m. by Dwight Nelson, the Conservation, Sanitation, and Zoning Committee Chairman, in the Grant County Board Room #264, 111 S. Jefferson St., Lancaster. Board members present: Dwight Nelson, Mark Stead, Lester Jantzen, Grant Loy, Gabe Loeffelholz, and Roger Guthrie; Dale Hood arrived at 9:35 a.m. Others present: Lynda Schweikert, Annette Lolwing, Kevin Lange, Justin Johnson, Joe Schmelz, Nathalie Schattner, Bob Keeney, Chuck Tennessen, Don Pluemer, John Dalsing, Rob Danielson, Richard and Laurie Graney, Patrick and Marlene Patterson, Pat Schroeder, Brad Klaas, Dan Dressen and Jeff Kaiser. Certification of Open Meeting Law Annette Lolwing sent the agenda to Karla Schwantes and Linda Gebhard to post in the Administration Building and at the Courthouse, also sent an agenda to Bob Middendorf, WGLR, and was posted in the front of the Ag Service Center Building. Media notices were sent to Karla Schwantes, Linda Gebhard, Herald Independent, Tri County Press, Platteville Journal, Muscoda Progressive, and the Boscobel Dial. Approval of Agenda Motion by Lester Jantzen, seconded by Roger Guthrie to approve the October 3, 2017 agenda with a change that Southwest Badger RC&D/Wendy Warren will not be attending the meeting and will be removed from the agenda. Motion carried. Approval of the Minutes Motion by Mark Stead, seconded by Grant Loy to approve the September 5, 2017 minutes with a correction on page 2 to add Jantzen to Lester’s name. Also, page 3 under Budget approval, for the carryover account to be set up for the Permit fee from Law Enforcement Building. Motion carried. Review & Accept the Bills Motion by Roger Guthrie, seconded by Gabe Loeffelholz to accept the bills. Motion carried. Public Hearing for Rezones Chairman Nelson opened the Public Hearing: #17-19 Donavin & Delvin Wilhelm, Potosi Twp. are requesting a Conditional Use Permit on PIN: 052-01074- 0000 of +/- 1.88 ac. from FP to A2. To allow for the use of a non-farm residence. In Favor: Potosi Twp., approved on August 14, 2017. In Opposition: None. In Interest: None. Committee Discussion: None. Dwight Nelson closed the Public Hearing: Motion by Lester Jantzen that the items are concurrent with all the conditions on the Farmland Preservation Worksheet and to recommend approval of the rezone to the full County Board, seconded by Roger Guthrie. Motion carried. (See Attachment A Worksheet) Public Hearing for Conditional Use Permits Chairman Nelson opened the Public Hearing: #CUP 17-006 J&C Realty, Jamestown Twp. is requesting a Conditional Use Permit on PIN: 026-00206-0000, 026-00095-0000, 026-00095-0020, 026-00189-0020, and 026-00189-10 of +/- 41.89 ac. to allow for the use of a planned unit development, Chapter 3.21 (4) of the Grant County Comprehensive Zoning Ordinance. In Favor: Jamestown Twp., approved on August 15, 2017. The Town of Jamestown did not impose any conditions on this permit. Justin handed out a sheet that explained the Planned Unit Development Setbacks: Fixed standards/setbacks (can’t deviate from) & Variable standards/setbacks (can have flexibility with) in the Comprehensive Zoning Ordinance. Dan Dressen with Delta Engineering registered in favor and explained the proposed subdivision. Jeff Kaiser also registered in favor of the CUP, did not speak. John Dalsing, Jamestown Supervisor registered and spoke in favor. John commented that the Jamestown Town Board and Planning committee have approved and are in favor of the project. In Opposition: Justin received a phone call, in opposition, from a neighbor that has a manure pit and has concerns that he will be pushed off of his farm with the Ag smell coming from that pit. Justin reiterated that the farmer will be protected by the Freedom to Farm Act, and also Jamestown does not have a Livestock sighting ordinance, so he should be protected by those 2 items. In Interest: None Applicant Rebuttal – None Committee Discussion: Mark Stead asked that most of the lots are pretty uniform in size, except for a large lot, it was explained that the large lot will be used for a Storm Water Management Facility. Dwight Nelson closed the Public Hearing Motion by Mark Stead, seconded by Lester Jantzen to approve the Conditional Use Permit to allow for the use of a planned unit development, Chapter 3.21 (4) of the Grant County Comprehensive Zoning Ordinance. Motion carried. Chairman Nelson opened the Public Hearing: #CUP 17-007 – Klaas Construction LLC is requesting a Conditional Use Permit on PIN: 056-00076-0000 of +/- 1.0 ac. to allow for the use of a mini storage structure, Chapter 3.11 (2) (h) of the Grant County Comprehensive Zoning Ordinance. In Favor: South Lancaster Twp. approved on September 13, 2017. The Township did place one condition on this request. They are not to go any closer than 20 feet to the rear property line. Applicant was given the option to provide a statement but did not wish to speak. In Opposition: None In Interest: This was permitted under the old zoning ordinance, but due to the update of the Comprehensive Zoning Ordinance it is now being brought forward to a Conditional Use Permit. Committee Discussion: None Dwight Nelson closed the Public Hearing Motion by Grant Loy, seconded by Gabe Loeffelholz to approve the Conditional Use Permit to allow for the use of a mini storage structure, Chapter 3.11 (2) (h) of the Grant County Comprehensive Zoning Ordinance with the condition of: They are not to go any closer than 20 feet to the rear property line. Public Hearing for Preliminary Plat Chairman Nelson opened the Public Hearing: #PPA 17-001 – J&C Realty are requesting a Preliminary Plat request on 026-00206-0000, 026-00095-0000, 026-00095-0020, 026-00189-0020, and 026-00189+0010 of +/- 41.89 ac. to allow for the use of a subdivision in the Grant County Comprehensive Zoning Ordinance. In Favor: Jamestown Twp. approved on August 15, 2017. Dan Dressen registered in favor. One other individual registered in favor, but wished to not speak. Stated they are required to obtain Preliminary Plat approval from the DOA (Department of Administration). In Opposition: Had an adjacent landowner in opposition, regarding the Ag odors. In Interest: None. Justin brought forward a sidewalk provision in the Comprehensive Zoning Ordinance. They are to install at least 1 sidewalk on one side of the street. There are no sidewalks being proposed. Dan proposed to the Township on August 15th that they were not going to install sidewalks. There are no other sidewalks in the village of Kieler. Committee Discussion: Gabe asked if there were any thoughts of installing sidewalks in the future. Answer was No, Not at this time. Motion by Mark Stead, seconded by Gabe Loeffelholz to approve the Preliminary Plat request with J&C Realty in Jamestown Twp., along with the condition that the (DOA) Department of Administration approves the Preliminary Plot plans. Once approved, the plans would be submitted to the County Engineer, then the Final Plat would then go to the Township, then submitted to the Conservation, Sanitation, and Zoning Department within 3 years of approval. Motion carried. Liberty Township Variance Fee Exemption Request - Pat Schroeder Pat Schroeder, Liberty Township, is asking to waive the variance fee for a piece of property in Stitzer that they purchased at a sheriff’s sale. The lot is zoned as C-1 and is too small to build on. Motion by Roger Guthrie, seconded by Grant Loy, to approve the variance fee for Liberty Township to be waived. Motion carried with one negative vote and 1 abstention. Zoning and Sanitation Report Lynda reported that 17 Townships have adopted the updated Comprehensive Zoning Ordinance. Letters were sent to Lima and Millville Township reiterating that they have until June 20, 2018 to adopt the updated Ordinance, if they don’t adopt it there will be no Comprehensive Zoning Ordinance covered in those Townships, they will no longer be eligible to participate in receiving any Farmland Preservation tax credits. Lynda reported that they are still working on the verbage in the mitigation portion of Shoreland Ordinance. Will submit it to the DNR in the next couple of weeks. Board of Adjustment met on September 21, 2017 for a road and vision triangle setback request. The road had been Platted after the purchase and construction of a house on this property affecting/changing their side yard setback to a center line road setback. The Board of Adjustment did vote to lessen their center line road setback to what it would be for a side yard setback. The vision triangle on a Town road is 150’. The vision triangle setback was lessened to about 85’. Lynda reported that on September 25, 2017 they have sent out around 290 2nd notices for the 3 year maintenance forms. Second notices are due October 31st. Lynda handed out a chart for the maintenance report comparisons from last year, 2016 there were 400, 2nd notices sent out; this year, 2017, there were 209 2nd notices sent out, a 110 reduction in notices that were sent out. There were 320 maintenance forms received by our office the last week of August. Late fees were increased from $25.00 to $100.00. Late fees ARE being enforced. Lynda reported that there was an increase in the maintenance fees from 2016, 1947, compared to 2017, with 2037. There was also an increase in the Sanitary Permits from 2106, 96 permits, 2017, 101 permits; Zoning Permits from 2016, were 94 permits, and in 2017, there were 112 permits issued. Justin reported that August had the most permits so far with processing 30 permits. Motion by Mark Stead, seconded by Lester Jantzen to accept the Zoning/Sanitation Report. Motion carried. Discussion on Potential Informational or Oppositional Resolutions Regarding Cardinal Hickory Creek Transmission Line - Rob Danielson There were several individuals that wished to speak in opposition of the Transmission Line. The first registered speaker that gave the introduction was Patrick Patterson, Mt Hope Twp.; the second individual that registered to speak was Laurie Graney, Lima Twp., near Platteville. The Graney’s 178 year old family farm is in the corridor of the transmission line, concern with the environment around the area. As of now their corridor has been inactivated. The third registered speaker was Chuck Tennessen who spoke for the Driftless Land Conservancy. They protect around 7,000 acres in Southwest WI. Their mission is to maintain and enhance the health and beauty in Southwest WI. The Transmission line is a 125 mile line from Dubuque County to Montfort including a 40.0 ac. substation. Gave a few reasons why this is not a good thing: 1. These lines are just not needed. 2. In 2010, it was assumed a 1% growth that has not occurred. 3. Cause environmental degradation in SW WI. They are guaranteed a 10.2% profit on anything they construct and maintain. 4. A misconception on this line… This is an open access line, not necessarily a “green energy project”. Handed out a copy of a resolution from Iowa County. The 4th registered speaker is Rob Danielson, Vernon County, mentioned that the state does not require a cost/benefit analysis. The 5th registered speaker is Don Pluemer, Montfort, a member of Trout Unlimited. Mentioned that they are planning a 17 story substation for the new transmission lines just outside of Montfort. Looking for support in opposition of this project. The 6th registered speaker is Dick Graney, Lima Township, thanked the Committee for their attention in this matter, and hope they can come back again at a later time. Southwest Badger RC&D – Wendy Warren Postpone until November CSZC meeting. County Cost Sharing Starting balance is $4,475.28. No Extension or Cancellation Requests. Lynda presented final approval request for county cost sharing on a well decommissioning for Brian and Bonnie Crapp, Mt. Hope Twp., $620.00. Motion by Mark Stead, seconded by Dale Hood to approve payment. Roll Call: 7 Yes, 0 No, 0 Absent. Motion carried. Lynda presented final approval request for county cost sharing on a well decommissioning for Vesperman Corp., Kyle Vesperman, South Lancaster Twp., $570.70. Motion by Dale Hood, seconded by Lester Jantzen to approve payment. Roll Call: 7 Yes, 0 No, 0 Absent. Motion carried. Lynda presented tentative approval request for county cost sharing on 3 well decommissionings for Errol Schluter Marion Twp., $1,000.00; Leslie Wagner, Lima Twp., $700.00; and David Dailey, Lima Twp., $880.00. Motion by Mark Stead, seconded by Grant Loy to approve all 3 requests. Motion carried. Ending Balance: $2,104.58 SWRM Cost Sharing 2016 DATCP Cost Sharing – Beginning balance is $2,726.08. All 2016 practices have been installed. Practices came in under the cost estimate which leaves an underspending of $2,726.08. Ending Balance for 2016 DATCP Cost Sharing: $2,726.08. 2017 DATCP Cost Sharing – Starting Balance: $12,266.61. Lynda presented final approval request for 2017 DATCP cost sharing on a streambank protection project for Travis and Hilary Cliff, Patch Grove Twp., $3,452.50. Motion by Mark Stead, seconded by Roger Guthrie to approve payment. Roll Call: 7 Yes, 0 No, 0 Absent. Motion carried. Lynda presented final approval request for 2017 DATCP cost sharing on a grade stabilization structure for Strye LLC, Glen Haven Twp., $8,946.20. Motion by Mark Stead, seconded by Grant Loy to approve payment. Roll Call: 7 Yes, 0 No, 0 Absent. Motion carried. Lynda presented tentative approval request for 2017 DATCP cost sharing on a manure storage closure for John and Lynn Batko, Liberty Twp., $5,600.00. Motion by Roger Guthrie, seconded by Gabe Loeffelholz to approve Batko’s request. Motion carried. Ending Balance for 2017 DATCP Cost Sharing: $9,018.41. Storage Permit Approval To Construct: Lynda reported that Brian and Bonnie Crapp, Mt. Hope Twp. have no plans approved for the construction of a manure storage facility. Withdrawn the permit request approval. Postponed until the November meeting. Lynda reported that Jason Sensenig, Ellenboro Twp., has no plans for approval for the construction and the abandonment of a manure storage facility. Withdrawn the permit request approval. Postponed both requests until the November meeting. Lynda reported that Greg VanNatta, Little Grant Twp., is constructing a concrete stacking pad with concrete walls on 3 sides with a curb on the front to contain liquids. This is for 100 head of beef cattle. Construction design was completed by Erik Heagle, our office; approved by Dave Russell, DATCP engineer. Have paid their $200.00 permit fee. Motion by Roger Guthrie, seconded by Mark Stead to approve the permit. Motion carried. Lynda reported that Timberwolf LLC, Liberty Twp., are a large hog facility. DNR has approved their construction plan for 7,595 swine in this facility. This will be a concrete storage facility. Construction plans were submitted by REA, and were reviewed by Bernard Michaud, WI DNR engineer. They have paid their $200.00 permit fee. They are over the 1,000 animal units and are permitted by DNR. Motion by Roger Guthrie, seconded by Gabe Loeffelholz. The vote was 4 in favor, and 3 Nay votes to approve their permit. Motion carried. Lynda reported that Tranel Family Farms is abandoning a concrete storage facility for dairy. The Construction Plans were drawn up by Dave Mours, NRCS. Permit fee of $50.00 has been paid. Motion by Mark Stead, seconded by Roger Guthrie to approve their permit. Motion carried. NACD Dues Lynda reported that we do budget $775.00 for NACD dues in our annual buget, however, we spent $529.17 to have the Litanies, and 5th grade activity books printed. Motion by Roger Guthrie, seconded by Gabe Loeffelholz to approve $225.00 to pay towards the NACD dues. Motion carried. Create Carryover Account for Law Enforcement Center Zoning Fee Lynda reported that last month when we approved the budget, the $21,000 permit fee from the Law Enforcement Center was approved by the County Board. It was discussed that the $21,000 would be placed in a carryover account to be used to offset the cost of the increase in our building rent. Motion by Mark Stead, seconded by Lester Jantzen to create this carryover account. Motion carried. Approval of Carryover Accounts Lynda handed out a list of our carryover accounts; with an explanation of the purpose of the carryover. Motion by Mark Stead, seconded by Grant Loy to accept the carryover accounts as presented. Motion carried. CSZD Administrator Report Lynda reported that she received a copy of the full lease that Dave Bainbridge signed with NRCS and FSA. It is a very comprehensive lease. The lease was submitted to Ben Wood for herself and Ben to review it together to make sure we want to use in entirety for ourselves. Hope to have the lease ready for signatures by the November meeting. Lynda reported on the 2018 Budget Update. The 2018 DATCP allocation has been sent out. It is down from 2017. Staff and support is down by $1,747, SWRM cost sharing is down by $11,800, because of the 3 years of underspending percentage of 5% cost share dollars. Lynda reported on the Wisconsin Veteran’s Farm Bill Resolution, it was approved by our Veteran’s Committee. Will be taking the resolution to the full County Board on October 3rd. Lynda reported that the soil sampling seminar had been offered September 12, 2017. There were 7 people that were invited, but only 2 showed up for the class, and 1 dropped out of the class afterwards as he stated that it was way too much for him to deal with. The class numbers are way down. They are in their 2nd round of spotchecks. Most landowners have already been going through an Agronomist, or have taken the class themselves. Lynda reported that there were 6 volunteers from our office that showed up to help at the Clean Sweep on Saturday, September 9th. The people that brought things in for the clean sweep were in and out in about 3 minutes. The crew was very efficient. Very thankful to the County for allowing us to have the clean sweep in Grant County. Lynda reported that she is a member of the Multi Hazard Mitigation Team. They had met on September 26th. They will then visit several of the Townships. Highly suggested that if this is in your area you are strongly advised to attend. This is needed for FEMA. By having this report it makes Emergency Management eligible for grant money to help offset any costs of these situations. Grant County is the number one county in the state for disaster declarations. The advisory team won’t meet again until January or after Steve has meet with all the Townships. Lynda reported that she attended a Farm Bureau Annual meeting. She was the guest speaker for the evening. She spoke on cost sharing, producer led watersheds, and the DNR Forester position in Grant County. Lean Update Lynda reported that the only Lean project she is working on was her Sanitation Lean Project review. Starting to see that some of the Lean changes are making a difference. FPP Report Kevin reported that he has completed all the CREP reenrollments last month. He is now working on some new sites, has GPS’s a few sites.  Is working on his FPP spotchecks  Completed a couple of Contour Strip jobs.  On October 16th he will be helping Green County get ready for the Tri-County Land Judging contest. He will be helping with the digging of the pits and prejudging the pits. Contest will be held on October 18th, 2017. NRCS Report – Joe Schmelz  Joe reported that they are officially in Fiscal Year 2018. Everything they will be working on now will be going toward FY18.  EQIP application deadline is October 20th. Have until December 1st to have all the planning and designs ready to go for the ranking process.  Still working to get FY17 practices done. Should be a very minimal carryover for EQIP. Most things that were scheduled to be installed will get done. Will only have around 15 contracts to roll over from multiyear contracts. Only a very few 1-year contracts will be rolled over to 2018.  Joe reported that they are waiting for funds from congress for the CSP payments. NRCS has around 40 contracts. All 17 CSP practices have been certified. Has 2 contracts expiring this year: one is renewing their contract and one decided not to renew.  CRP is still at a standstill. CREP is still under open enrollment.  We should know more regarding The Ultima employee, an Office Clerk, in late October, early November.  Joe reported that we are one of the top 3 Counties in the state for CSP contracts, consisting of approximately 10,000 acres.  They had a good year for installing practices, they made around 60 EQIP payments, with 130 to 140 practices on the ground totaling $1.1 million. New contracts that were signed this year were around $900,000. FSA Report Nathalie Schattner, the new CED at the FSA office came to introduce herself and to give the FSA report. She spent the last year training with the Richland County staff.  She reported that they have received no word on CRP, but they are continuing to take offers.  CRP payments should be coming out in a step process this month.  Fall crop reporting deadline is due November 15th, for cover crops, pasture, grasses and all forage.  New Mal Loans (Marketing Assistance Loans) are available for those who want to store 2017 crops to receive a loan on them and wish to sell at a more favorable time.  They will be hiring another person to help with the work load.
